Terms and Conditions of Use (TCU)
Article 1 – Purpose
These Terms and Conditions of Use (TCU) govern the access and use of the Melya platform, developed and operated by Ensilog SAS, enabling the automatic digitization of paper questionnaires via AI, manual verification, generation of natural language summaries, and creation of personalized dashboards.
Article 2 – Access and Acceptance
1. Early Access: The candidate submits their application and accepts these TCU during this step.
2. Commercial Access (SaaS): The user checks the "I accept the TCU" box during registration to create an account. Any use of the platform implies full acceptance of these TCU.
Article 3 – User Account
- The user provides an email address and a password or uses Google/Microsoft SSO.
- The user is solely responsible for the confidentiality of their credentials and all activities on their account.
- If the password is forgotten, the reset function sends an email to the registered address.
- In case of a TCU violation, the account may be suspended. If payment is not made, access is read-only with a history limited to 6 months.
- The user can delete their account and data directly from the application.
Article 4 – Availability and Maintenance
- No SLA guarantee is provided.
- Scheduled maintenance: email notification 1 week in advance.
- Unplanned interruption >24 h: users are notified by email.
Article 5 – Pricing and Payment
- Free early access, restricted registration. Eventually, a monthly SaaS subscription. Beta testers benefit from a 40% lifetime discount on the catalog price, regardless of the chosen plan.
- Payment via Stripe (credit card or SEPA direct debit).
- In case of late payment, a 15-day grace period is applied, followed by restricted access (read-only, 6-month history). Automatic reminders via Stripe, with no additional fees.
- The deadline is determined by the initial subscription date; modifications are billed pro-rata.
Article 6 – Duration and Termination
- No commitment. Automatic renewal according to the chosen period.
- The user can disable renewal up to 2 days before the deadline via their account.
- Termination is possible at any time via the Stripe portal. Rights are maintained until the end of the current period, after which access switches to read-only with a limited history.
Article 7 – Intellectual Property
- The source code, AI, and documentation are the exclusive property of Ensilog SAS.
- The questionnaire templates and generated documents are the property of the user. A simple usage license is granted for access and operation of the service.
- The user retains ownership of their data. It may be used anonymously for product improvement.
Article 8 – Authorized Use and Prohibitions
- The user is authorized to submit their own manually filled paper questionnaires. Any other document is not intended for processing.
- Personal and sensitive data (name, address, religion, etc.) should not be submitted; surveys must remain anonymous.
- Prohibited: reverse-engineering, security circumvention, use of bots or scripts for non-standard usage.
- In case of non-compliance, data and/or account deletion may be enforced.
Article 9 – Liability and Warranties
- Ensilog makes its best efforts to ensure service availability and security, without guaranteeing a specific result.
- Non-exclusivity: the user is free to use other similar tools.
- Limitation of liability: liability is limited to direct and foreseeable damages, excluding any indirect, immaterial, or unforeseeable damage.
- Force majeure: neither party shall be held responsible in case of an event beyond its reasonable control.
Article 10 – Data Protection
As a processor, Ensilog complies with the provisions of the Privacy Policy. For more details, please refer to our Privacy Policy .
Article 11 – Modification of the TCU
Ensilog reserves the right to modify these TCU at any time. Users will be informed by email at least 15 days before the new terms come into effect.
Effective Date: May 18, 2025.
Article 12 – Governing Law and Disputes
These TCU are governed by French law. In case of a dispute, the courts of Mâcon will have sole jurisdiction. The user may also opt for mediation or arbitration.
